La femme dispose d&rsquo;un d\u00e9lai de dix ans apr\u00e8s la naissance de l&rsquo;enfant pour faire une action en recherche de paternit\u00e9 et, si ce d\u00e9lai est \u00e9chu, l&rsquo;enfant dispose lui-m\u00eame de dix ans apr\u00e8s sa majorit\u00e9 pour entamer une proc\u00e9dure. C&rsquo;est le juge qui d\u00e9cide d&rsquo;une expertise g\u00e9n\u00e9tique. Si l&rsquo;homme refuse de s&rsquo;y soumettre, pour beaucoup de magistrats, cela peut prouver qu&rsquo;il sait \u00eatre le p\u00e8re biologique. Sauf que, comme le souligne \u00e0 juste titre <strong>Mary Plard<\/strong>, la femme enceinte dispose d\u2019une assez grande libert\u00e9 personnelle : elle d\u00e9cide, seule, de garder l\u2019enfant \u00e0 na\u00eetre ou de proc\u00e9der \u00e0 une IVG, elle peut d\u00e9cider de ne pas informer de sa grossesse, et donc de sa paternit\u00e9, l\u2019homme qui a seulement travers\u00e9 son existence et avec lequel elle ne veut plus conserver de lien, et elle peut m\u00eame, \u00e0 la naissance, d\u00e9cider d\u2019accoucher \u00ab sous x \u00bb, privant ainsi son propre enfant de la connaissance de l\u2019identit\u00e9 de sa m\u00e8re, et a fortiori de son p\u00e8re.<\/span><\/p>\n<\/blockquote>\n<p style=\"text-align: justify;\"><strong><span style=\"color: #000000;\">En France :<\/span><\/strong><br \/>\n<span style=\"color: #000000;\">L\u2019action l\u00e9gale de recherche de paternit\u00e9 est une \u00e9p\u00e9e de Damocl\u00e8s au-dessus de la t\u00eate de certains hommes. <\/span><\/p>\n<ul>\n<li>La m\u00e8re dispose d\u2019un d\u00e9lai de 10 ans pour d\u00e9clencher une action en justice.<\/li>\n<li>L\u2019enfant suppos\u00e9 dispose d\u2019un d\u00e9lai de 10 ans apr\u00e8s sa majorit\u00e9 (soit 28 ans apr\u00e8s la naissance).<\/li>\n<li>Le p\u00e8re \u00e9ventuel n\u2019a pas le droit d\u2019avoir l\u2019initiative d\u2019un test de paternit\u00e9 et ainsi de v\u00e9rifier qu&rsquo;un enfant est bien de lui.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"","protected":false},"author":2,"featured_media":2829,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_genesis_hide_title":false,"_genesis_hide_breadcrumbs":false,"_genesis_hide_singular_image":false,"_genesis_hide_footer_widgets":false,"_genesis_custom_body_class":"","_genesis_custom_post_class":"","_genesis_layout":"","footnotes":""},"categories":[55],"tags":[],"class_list":{"0":"post-2825","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-societe","8":"entry"},"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.1.1 -
